Impeachment is different from "removal of office".

The house of representatives does the "impeaching" which is like a grand jury indictment.

The senate acts the JURY, and u need 2-thirds of the senate to agree that the president is guilty. Which is at least 67 senator, anything less than 67 acts as a an "acquittal", and the president would remain in office.

His last impeachment, only got like 48 guilty votes, with only 1 republican voting guilty. Which was Mitt Romney, in the senate.

So impeachment is only the begin of the "due process", if successful.

So as of now Trump is "innocent until proven guilty", like in a criminal trial.

They succeeded in the house, like last time, but now they must impeach him in the senate, which is Democrat controlled for the first time in a decade.

Very interesting to watch, senate comes back to work on the 19th.

I don't think they can get 2/3rds. The Senate won't hold the "trial" until Trump has gone. So, conviction will just get rid of his pension. After that conviction vote, though, they can do a separate vote to disqualify from future office. That just requires a majority of Senators, and that will keep him from being able to run for president ever again.

When a president is impeached by the House of Representatives, it is required by the Constitution that the US Senate hold a trial to determine if he will be removed from office. Because his term ends in less than a week, it will be virtually impossible to orchestrate a trial and verdict before January 20th, 2021. So, unless he resigns, or Pence decides to activate the 25th Amendment, Trump will remain president for his entire term, which sucks.

The good news is that while Trump is still president, and will likely remain president until January 20, 2021, 12:00 pm, the fact that he has been impeached, and hasn't had a trial by senate to determine if he will be removed, his powers as president has been somewhat limited. For instance, he will not be able to issue any pardons until after he is acquitted in his trial. So to put it in simplistic terms - Trump is still a dick, but he's a dick with no balls...

The question I have that I'm trying to get answered is, since Trump's trial for removal will be symbolic because it is happening after his term ends, will the other penalties that come with it still apply, such as him losing his pension and his secret service protection. That's what needs to happen.

Fun fact: Inauguration or not, come January 20th, 2021 at 12:00pm, Donald Trump will no longer be president of the United States and Joseph R Biden Trump will. The inaugration is not necessary or required for that to happen, and is just ceremonial.. Smile
